Offer Description
The research project focuses on the comparative analysis of legal instruments, both traditional and newly developed, for the protection of productive activities of significant national interest in international commercial contracts and litigation. Starting from a comparison of the solutions adopted in the main legal systems, the research examines the impact of such public-law measures on the provate-law institutions of international contracts, such as force majeure, hardship, and compliance clauses, and on transnational litigation and arbitration, with regard to arbitrability, public policy and overriding mandatory rules. The comparative and case-based method aims to identify convergences and divergences between models, in order to develop a systematic framework and operational proposals.
