Job PurposeRecordati is building its legal and IP talent and seeking an exceptional, qualified patent attorney with a broad skillset and global experience to join the newly formed IP team and help drive the transformation and execution of the Recordati IP strategy. Reporting to the Head of IP, the Lead IP Counsel, Corporate Development and Portfolio will serve as a strategic partner to internal business partners on patent matters and provide a full range of IP support to advance the Company's business objectives. In particular the team member will help to drive our IP assets focusing on our corporate development and identifying and protecting our R&D accomplishments. As a key team member, this individual must be a highly motivated team member who is comfortable both collaborating as part of a larger team and working proactively and independently to provide support for complex, fast-moving businesses. The ability to deliver clear, concise, and actionable IP advice to business leaders and management is essential. The team member must be creative, flexible and pragmatic. An innovative individual that is not afraid to see things differently or try something new is encouraged to apply. Key Responsibilities•    Partner with the business to protect and enhance the Company's IP assets to create and maintain competitive advantage.
•    Provide strategic IP counseling to our business on all aspects of pharmaceutical patent law, including exclusivity issues and launch scenarios.
•    Collaborate with internal lawyers as appropriate to provide intellectual property support.
•    Provide strategic counsel on all IP prosecution, diligence and related matters and coordinate and manage outside patent counsel to prepare and prosecute patent applications globally.
•    Identify patentable inventions through frequent interactions with internal R&D project teams and collaborators, including evaluating inventions, conducting prior art searches, filing, and prosecuting patent applications before the EPO, USPTO and globally with internal stakeholders and outside IP counsel where appropriate to obtain and maintain a commercially significant portfolio.
•    Collaborate with business development team and external partners on IP-related alliance matters and advise the Company of its IP rights and obligations under such licensing, collaboration, and other agreements.
•    Conduct IP due diligence for in-licensing and acquisition opportunities.
•    Analyze third party patents against prior art and Recordati technology; provide clear and practical legal guidance and risk assessment on freedom to operate and validity inclusive of risk assessment.
•    Manage oppositions and other contested proceedings as well as strategic IP intellectual property-related litigation, leveraging internal and external resources to achieve successful resolution.
•    Review proposed scientific disclosures in publications and presentations for potential impact on the patent portfolio and oversee disclosure review policies and procedures.
•    Create and enhance IP awareness within the Company through training, and implementing IP policies, guidelines and procedures.
•    Vision to identify and implement new processes, ideas and ways of working to optimize IP and create value.Required EducationRegistration to practice before the U.S. Patent and Trademark Office or qualified as a European Patent Attorney.Minimum of a bachelor's degree in science or engineering. Degree in chemistry, biochemistry, or similar discipline preferred. Advanced degree highly preferred.Required Skills and Experience7 + years of professional experience practicing as in-house attorney in biotech/pharma intellectual property portfolio creation, strategy, and counseling; ideal candidates will have practiced patent law both at a law firm and in a corporate legal department.Meaningful preparation and prosecution experience with biotechnology or biopharmaceutical subject matter.In-depth knowledge and experience in counseling drug discovery and development and commercial launch. Proven track record of patent portfolio development.Experience and passion for managing intellectual property on a global basis, with demonstrated ability to strategize and provide counsel on protecting intellectual property.Deep understanding of global pharmaceutical patent laws and best practices and experience with US, EU, and other patent systems, including filing and prosecution processes, patent searching, freedom-to-operate analysis, and patent challenge proceedings.Excellent drafting, negotiation, and communication skills.Business acumen and demonstrated ability to partner with business, including pragmatic, business-astute counseling ability. Experience with business development agreements with IP implications.Demonstrated ability to effectively communicate with all levels of management and all departments, subsidiaries, and affiliates, including international affiliates.Effective strategic and analytical leader with creative problem-solving abilities to properly balance risk with commercial objectives, providing creative solutions.Technical CompetenciesChampion intellectual property, creativity, and innovation in all forms to help build and enhance a growth and innovation culture across the Company.Provide strategic partnering with the business, and subject matter expertise across the Company.Required LanguagesEngish fluent
